Passion Analytics, Inc. provides an online platform and related services (the “Services”) internationally via one or more of our websites, our mobile applications and/or associated services (collectively, the “Site”).

By accessing or using our Site, you agree to be bound by this Privacy Policy, as periodically updated (the “Privacy Policy”) and all other policies applicable to your use of the Site (collectively, the “Policies”).The Site is not intended for access by individuals without the capacity to be legally bound by these Policies. 

  1. INFORMATION COLLECTED BY US
    • When you use the Services, you may provide us with information about you, including your name and contact information. We may also collect information related to your use of the Services and aggregate this with the information we obtain from other users of the Site. This helps us to improve our Services and deliver a better user experience to you.
      • Personally Identifiable Information (“PI information”): In the course of using the Services, we may require or otherwise collect information that identifies you as a specific individual and can be used to contact or identify you. Examples of PI information include your name, email address, billing address, and phone number.
      • Payment Information: If you use the Site to purchase Services, we will collect certain payment information, such as credit card, PayPal or other financial account information.
      • Age Restrictions: The Site is intended for users 13 years and older. However, only users 18 years or older may purchase Services from the Site. We do not knowingly collect PI information from anyone younger than age 13. If we become aware that a child younger than 13 has provided us with PI information, we will use commercially reasonable efforts to delete such information from our files.
      • Other Information Collected by Us: We may collect generic, anonymous or non-PI information from you (together, “Non-PI information”), such as zip codes, demographic data, preferences and information regarding your use of the Site. We may use Non-PI information to understand your interests and connect your activities on the Site. We may also use this information to improve our Site and to deliver appropriate and relevant advertisements to you. However, if we combine this Non-PI information with your PI information, we will treat all the resulting information as PI information and protect it accordingly.
    • You are not required to provide to us any information. However, if we do not receive certain information from you, we may not be able to provide our Services to you and certain portions of the Site may not be accessible to you.
  2. INFORMATION COLLECTED BY THIRD PARTIES
    • If order to provide you Services, we may use third party vendors, contractors, tools, or software, such as Chabot platforms, email marketing software, file storage and webhosting companies. Such third party vendors, contractors, tools, or software may have access to your PI information and Non-PI information, including your browser and operating system information, search terms you used to find the Site and areas of the Site you visited. Third party vendors may also use cookies or similar technologies to administer the Site, track your movements on the Site, and to gather other information. In addition, certain third party vendors may collect similar information for security and fraud detection purposes. These vendors will comply with our Privacy Policies in all respects and will comply with our instructions regarding the use of your information.
    • If you access the Site through the Facebook Messenger platform, please note that as part of the Services we provide to you through Facebook Messenger, we receive basic information about you from Facebook: your first name, location, timezone and gender. No matter the nature of the Services you receive from us, we will not post anything to your Facebook wall or notify your friends that you are using the Site or the Services unless you explicitly opt-in and choose to share our Site or Services on Facebook. If you choose to post a GIF or a video to Facebook based on your conversation with us, the post may have a link to the Site. Your conversations with us within Facebook Messenger are subject to the Facebook privacy policy, which is available here: https://www.facebook.com/privacy/explanation. Facebook can access all the information you provide to us through Facebook Messenger platform, including the content of our conversations.
  3. USE OF INFORMATION & DATA RENTION
    • We collect information from you in order to:
      • Provide relevant Services to you, improve content available on the Site, complete your purchases, address your inquiries and for compliance and internal business purposes.
      • Contact you as necessary with administrative inquiries, marketing or promotional materials and other information that may be of interest to you. You may decide at any time to stop receiving such communications from us.
      • Enforce and comply with all applicable laws and/or to prevent or stop activities that we may believe to be illegal, fraudulent or unethical.
    • Although we aim to keep your PI information confidential in all circumstances, we may share your PI information (i) with government entities, as required by law, (ii) with third parties as stated in our Policies, or (iii) if we are part of a merger, acquisition or corporate reorganization. To the extent required by law, we will notify you in advance before sharing your PI information with third parties.
    • We use commercially reasonable steps to protect and secure information collected by us. However, no method of transmission or data storage is fully secure and data breaches may occur. Thus, we cannot ensure and do not warrant the security of any information you provide to us. Our policy is to limit access to information to those employees or agents with a specific need to access or retrieve this information. While we agree to take all reasonable steps to protect your information, you acknowledge that the information you voluntarily share with us through the Site could be accessed or tampered with by a third party.  You agree that we are not responsible for any unauthorized use of information and release us from all claims arising out of or related to the unauthorized use of information by third parties.
    • Unless you request that we delete certain information, we may retain all collected information for at least five years. We may retain such information for longer periods pursuant to our backup and business continuity procedures.
  4. YOUR CHOICES AND RIGHTS
    • The profile you create on our Site will not be publicly accessible or visible to other users of the Site. You may also update your choices regarding the types of communications you receive from us through your online account.
    • If you disclose your information to a third party, or visit a third party website via a link from our Site, their privacy notices and practices will apply to any personal information you provide to them or they collect from you. We cannot guarantee the privacy or security of your personal information once you provide it to a third party.
    • You may request us to delete your PI information at any time. We will use commercially reasonable efforts to comply with your requests for deletion. However, we may retain certain information for administrative purposes in accordance with applicable laws.
  5. CHANGES TO THIS POLICY
    • We have the discretion to update this Privacy Policy at any time. Therefore, we encourage you to frequently check this page for any changes. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and to contact us with any questions.
